PDEA Compliance Service Advisory Regarding Dangerous Drugs

The Philippine drug enforcement agency, through its compliance service, has recorded an increase in the number of cases involving violations of DDB Regulations by PDEA-Registered clients.

PDEA reiterates strict compliance to all the regulatory control measures imposed on dangerous drugs and controlled precursors and essential chemicals as mandated under RA 9165, Board Regulation No. 3, S. 2003 and other regulatory board issuances, more  specifically on the following concerns:
  1. Importation of Controlled Precursors and Essential Chemicals (CPEC) without PDEA License and import permit  -B.R. No. 3, S. 2003, Section 6(2A) and (2B), respectively;
  2. Non-recording of dangerous drugs/controlled precursors in registers - B.R. No. 3, S. 2003 38(7) and 39(2), respectively;
  3. Late renewal of PDEA License - B.R. No. 3, S. 2003, Section 6(8); and
  4. Late submission of semi-annual reports - B.R. No. 3, S. 2003 Sections 38(3) and 39(2).
Violations shall be dealt with in accordance with DDB Regulations No. 5 Series of 2006:
  • FOR FIRST OFFENSE - FINE OF TEN THOUSAND PESOS (PHP 10,000.00) AND REPRIMAND
  • SUCCEEDING VIOLATION WILL BE PENALIZED UNDER SECTION 32, ARTICLE II OF RA 9165 - PENALTY OF:
    • IMPRISONMENT RANGING FROM SIX (6) MONTHS AND ONE (1) DAY TO FOUR (4) YEARS; AND
    • FIND RANGING FROM TEN THOUSAND PESOS (PHP 10,000.00) TO FIFTY THOUSAND PESOS (PHP 50,000.00) SHALL BE IMPOSED IN ADDITION TO ADMINISTRATIVE SANCTIONS.
